SOMALILAND LAND & PLANNING LAWS

URBAN LAND

The main law governing land in towns and other urban areas is the Urban Land Management Law (Law No: 17/2001) which has since been amended in 2008. The issue of land ownership, specially in towns, has been extremely controversial and is often one of the factors that leads to public order problems. Local authorities have the power  to grant title to urban land  and that  responsibility is vested in the executive committee of the District councils (or their Land sub committees). This Law has been criticised for setting up, under Article 28, a quasi-judicial committee chaired by a District Judge for dealing with disputes about urban land, but appeals against their decisions go to the Regional Court. This has now been amended and the disputes are now dealt with by  Administrative Urban Land Disputes Committees consisting of 7 members - 5 including the Chairman appointed by various central government ministries and 2 nominated by the district local authorities. Appeals against the decisions of the administrative committees, as in all challenges of administrative bodies’ decisions, lie with the Supreme Court within a very short time limit of one month. The committees will be based at the premises of the district councils and the Minister of Interior is given a power to issue regulations relating to the allowances of the members’  fees, the applications to the committees, their procedures and execution of their final decisions. Whilst this amendment makes it clear that the decisions on land disputes will now be taken by central and local government officials, and not, as previously, by a quasi-judicial body, the only appeal route to the Supreme Court (which unfortunately in Somaliland still deals with ALL appeals against administrative decisions - under Article 10(4) of the Organisation of the Judiciary Law  - Law No. 24/2003 & 2006) is likely to prove to be cumbersome, expensive and difficult to pursue.

Other than the changes to Article 28, the amendments to this 2001 Law which came into force  on 9 September 2008 (Presidential Decree 363/2008 of 09/09/2008) make minor changes to Articles 5, 7 and 29 of the Law.

Disputes over land have, in the past, led to occasional  presidential decrees stopping grants of new titles specially over land designated for public purposes, the last one of which was issued on 5 September 2003. The higher courts are also inundated with cases relating to such disputes and the Supreme Court recently issued a direction relating to such cases. 

The sale of public property is also a recurring issue.  For example, in 2007 a Presidential Decree, issued by the Vice-president as Acting President, declared a moratorium on the sale of houses/property owned by the government.

AGRICULTURAL LAND

So far as agricultural land is concerned, the main law is the Agricultural Land Ownership Law (Law No: 08/1999).

RURAL/RANGE LAND

No specific law covers these public areas, but Article 12(1) of the Constitution proclaims that all public law is owned by the government (for the public good).  The two laws above cover urban land and agricultural land (irrigated or rain fed land) and all other land is therefore assumed to be common public land.  Article 17 of the Agricultural Land Law makes it clear that no rain fed agricultural land will be taken out of the  common range lands. There have, however, been considerable enclosures of public range land over the last 20 years which have created serious problems for nomads and consequently led to many disputes.   Some of these issues are addressed in the various reports listed below.

XEERKA MAAMULKA DHULKA (Xeer Lr. 17/2001)

 GOLAHA WAKIILADA JSL

 Markuu Arkay:    qodobka 8aad, farqadihiisa 1aad iyo 3aad iyo qodobka 12aad, farqadihiisa 1aad, 3aad iyo 5aad ee Dastuurka Qaranka.

 WUXUU ANSIXIYAY XEERKAN:

QODOBKA 1AAD: AWOODDA MAAMULKA DHULKA.

 1-   Eebbe ka sakow, guud ahaan dhulka Jamhuuriyadda Somaliland  waxa leh Dawladda somaliland (sida uu tilmaamayo qodobka 12aad, farqadiisa 1aad ee Dastuurku). Sidaa awgeed awoodisa maamul , wareejintiisa iyo soo jeedintiisa Sharci u dejineed  waxay gaar u tahay Golaha Xukuumada

2-   Madaxweynaha JSL, markuu dhegeysto talada Golaha Wasiirada iyo Guddiga Qaranka ee Naqshadaha Guud ee magaalooyinka JSL, wuxuu soo saarayaa Xeer Madaxweyne oo lagu la wareegayo dhul  ama dhisme dan guud awgeed.

3- Dan guud waxaa loola jeedaa: meelaha laga samaynaayo, Jid Cusub, waddo balaadhin, buundo, layman Koronto, kuwo isgaadhsiineed, xafiisyo ama dhismayaal Dawladeed iyo wixii kale ee lagama maarmaan loo arko (Public Purpose) waxaana lagu soo saarayaa faafinta rasmiga ah ee Dawladda.

 QODOBKA 2AAD: AWOODDA DHUL BIXINTA.

1. Maamulka iyo bixinta jagooyinka dhisme ee Magaalooyinka (degmooyinka) dalka JSL, waxaa iska leh maamulka Dawladda Hoose (Guddiga Fulinta ee Dawladda Hoose).

2. Maamulka wixii dan guud ah sida: dhulka  xafiisyada iyo guryaha Dawladda, dublumaasiyiinta, wershadaha iyo dhammaan dhulkii hore loo odhan jirey (Shacab Area) waxaa iska leh Dawladda Dhexe.

3. Waxaa jiraya Xafiis ka Wakiil ah Guddiga Qaranka ee Naqshadaha Guud, kuna yaala Xarunta Wasaarada Hawlaha Guud ee heer Degmo, Gobol, iyo Qaran.

4. Xafiiska ku sheegan farqada 3aad ee qodobkan wuxuu hubinayaa waraaqaha Dhulka ee ka soo dhamaaday Maamulka Dhulka ee Dawladda Hoose inuu waafaqsan yahay naqshadda guud ee magaalo.

5. Waxaa reebban in Ciidamada qalabka sida iyo Hay’adaha kale ee Dawlada ee aan ahayn kuwa ku sheegan faqradaha 1aad, iyo 2aad ee qodobkan inay haba yaraatee wax faragalin ah ku sameeyaan maamulka arrimaha Dhulka.

 QODOBKA 3AAD: NAQSHADDA GUUD EE DHUL MAGAALO (MASTER PLAN)

1. Xafiiska Naqshadaha ee Wasaaradda Hawlaha Guud markay hesho amarka Guddiga  Qaranka ee nashqadaha  waxay dhulka magaalooyinka u sameynaysaa naqshad guud (master plan), oo lagu muujinaayo dhulka loogu talo galay:-

    1)     Degsiimada.  (Resedential )

    2)     Weshadaha. (Industrial )

    3)     Ganacsiga. (Commercial )

    4)     Danaha Guud. (Public purpose)

    a)    Waddooyinka.

    b)     Dugsiyada

    c)      Jardiinooyinka.

    d)     Barxadaha Gaadiidka la dhigto (Parking Area)

    e)     Xabaalaha.

 QODOBKA 5 AAD: NAQSHADDA GUUD EE MAGAALO (MAPING)  (Qodobkan waxbaa la bedellay)

1)  Naqshadda guud ee magaalo ama qaybo ka mid ah  waxaa soo codsanaya  Maamulka Dawladda Hoose, mar kasta oo ay timaado baahi keenta fidinta magaalo ama sameynta degsiimo cusub, iyagoo tilmaamaya jiida ay codsanayaan in la qorsheeyo .

2)  Xafiiska Nashqadaha ee Wasaaradda Hawlaha Guud waxay mar kasta khasnadooda ku kaydineysaa asalka (original) naqshaddaha guud ee magaalooyinka dalka JSL, iyadoo nuqulo ka mid ah la siin doono Dawladaha Hoose ee dalka, si ay dhulka ugu maamulaan iyo Wasaaradaha kale ee ay khuseyso naqshaddu, ee ka mid ah Guddiga Heer Qaran ee qodobka 4aad ku xusan.

 QODOBKA 6AAD: DIB U NAQSHADEYNTA MAGAALOOYINKA (RE-PLANNING OF TOWN-SHIP)

1)  Guddiga  Qaranka ee nashqaduhu markuu ka helo duqa magaalo codsi dib u nashqadayn magaalo (re-planning of town –ship) ama qaybo ka mid ah ama uu u arko inay lagama maarmaan tahay in loo sameeyo dib u nashqadayn sida jidad balaadhin, dib u habayn cabirka  jagooyin degsiimo, raris xeryo ciidan ama xarumo dawladeed  iwm. wuxuu ogolaanayaa in la sameeyo dib u naqshadayn.

2)  Guddiga Qaranka ee naqshadaha markay amarto Xafiiska Naqshadaha ee Wasaarada Hawlaha Guud samaynta dib-u-naqshadaynta ,duqa magaaladu waxa uu ku baahinaaya  wargaysyada iyo idaacada amarka  mabnuucidda dhisme cusub iyo dhamaystirka dhisme hore qabyo u ahaa iyo degida dhul cusub gabi ahaanba, mudada la dhamaynaayo samayta naqshadda cusub .

3)  Duqa magaaladu wuxuu ku wargelinayaa dadka ay dib-u-naqshadayntu saamaynta ku yeelatay muddo saddex bilood gudahood ah.

4)  Qiimaynta hantida iyo bixinta magdhawga hantida dib u naqshadayntu saamaysay waxa u xilsaaran Guddiga Qaranka ee Naqshadaha Guud.

 QODOBKA 7AAD: BEER-BIYOODKA MAGAALADU GAADHO  (Qodobkan waxbaa la bedellay)

1)  Beer-biyoodka (bustaan)  waafaqsan sharciga beeraha ee ay gaadho naqshada guud ee fidinta Magaaladu waxaa loo isticmaalayaa Jagooyin ( plots), dhul ahaana waxaa iska leh ciddii lahayd, wixiise dan guud looga qaado ee hanti ma guuraan ahi ku taalo sida: geed-midhood, ceel, barkad, Iwm waxaa loo celinayaa magdhow. (Beer-roobaadka “rain-fed farms” ma khusayso faqradani)

2)  Meelaha buuraha ah, sanaaga dhagaxa leh, boholaha iwm. ee Magaaladu gaadho looma aqoonsanaayo beer, mag dhowna laga celin maayo.

QOBOBKA 8AAD: JAGO BIXINTA KA REEBBAN MAAMULKA D/HOOSE.

1)  Maamulka Dawladda Hoose waxaa ka reebban in ay bixiso dhul ku yaala meelaha: Macdanta, dhul-beereedka, xeebaha, iyo meelaha danta guud loo qorsheeyay.

2)  Meelaha biyo mareenka ah, looma isticmaali karo jago ama dhisme kale, iyadoo laga duulayo in ay dhibaato ku keenaan degsiimooyinka kale , maadaama ay marin ka dhiganayaan meelo kale marka laga dego marinadoodii.

 QODOBA 9AAD: SAL-DHIGGA DHUL BIXINTA.

1)  Dhul (jago) kasta oo la bixinayaa waa inuu noqdaa mid ku saleysan ama waafaqsan naqshadda guud ee Magaalada ee ay ansixisay Guddiga Qaranka ee Naqshadaha.

2)  Jago kasta oo leh isticmaal rasmi ah waxaa lagu bixinayaa go’aan Guddiga Fulinta ee Dawladda Hoose oo adeegsanaya soo jeedinta xafiiska Qorshaha ee Dawladda Hoose.

3)  Maayarada Magaalooyinku waxay soo saarayaan Xeer midaysan oo khuseeya in cadaynta lahaanshaha jago banaan ay ka markhaati kacaan ugu yaraan sadexda Qof ee leh jagooyinka,hareeraha ka xiga ee dhisan ama banaan oo sharciyaysan.

 QODOBKA 10AAD: NOOCYADA LOO QAYBINAAYO DHULKA

1)  Dhulka ay bixinayso Maamulka Dawladaha Hoose ee loogu talo galay degsiimada (residential area) Magaalada wuxuu u qaybsamayaa laba nooc:-

    a)  Jago leh isticmaal rasmi ah.

    b)  Jago leh isticmaalka ku meel-gaadhka ah sida: xaafado loo qoondeeyay dadka dan yarta ah.

2)  Marka dhulka ku meel-gaadhka ah uu noqdo dhul leh isticmaal rasmi ah mudnaanta waxa la siinayaa, ciddii ku deganeyd isticmaalka ku meel gaadhka ah (hadduu ay awooddo dhaqaale ahaan) marka aaney jirin baahi dan guud ah.

3)  Dhulka leh isticmaalka rasmi ah wuxuu noqonayaa dhul leh dhisme ka samaysan gidaar (Dhagax Jaajuur, Laban, Shub iwm) iyadoo la raacayo naqshada dhismaha ee ay oggolaatay guddiga tayo/fayo-dhawrku (quality/hygen committee)

4)  Dhulka leh isticmaal ku meel gaadh ah waxaa laga dhisi karaa hoy ka samaysan Jiingado, aqal soomaali, cariish, loox, sarab.iwm

5)  Dhismaha ku tilmaaman farqadda 4aad ee qodobkan uma baahna in naqshad dhisme loo sameeyo. hase yeeshe , dhismuhu waa in uu yahay mid waafaqsan naqshada guud ee Magaalada iyo maamka Xaafadda.

QODOBKA 11AAD: U ROGID DHUL LEH ISTICMAALKA KU MEEL GAADH AH MID LEH ISTICMAAL RASMI AH.

Dhul leh isticmaal ku meel gaadh ah waxa loo rogi karaa mid leh isticmaal rasmi ah ka dib:-

1)  Marka qofka leh dhulkaasi uu soo weydiisto Maamulka Dawladda Hoose, isagoo fulinaya shuruudaha dhulka leh isticmaalka rasmiga ah.

2)  Dhulkaasi waa in uu ahaadaa mid waafqsan Naqshadda Guud.

 QODOBKA 12AAD LAHAANSHAHA DHULKA

1)  Dhulka leh isticmaalka rasmi ah qofkii la siiyaa waa in uu dhisme rasmi ah ku sameeyaa muddo sannad gudaheed ah laga bilaabo taariikhda dhulka la siiyay. Haddii uu mudadaas ku dhisi waayo waxa ku waajibaysa cashuur sanadeedka ku qeexan sharciga Tacriifadda  cashuuraha midaysan ee D/hoose (xeer Lr. 12)

2)  Dhulka ku meel gaadhka ah waxa la siin karaa cidda u baahan, waana in ay ku dhisaan muddo Saddex bilood gudahood, waxaana laga dhisi karaa noocyada dhismaha ku cad Qod.10aad, xubintiisa 4aad.

3)  Haddi qofka dhulka la siiyay uu dhisi waayo, isla markaana bixin waayo cashuurta ku waajibtay 2 sano oo isku xiga, wuxuu luminayaa xuquuqdiisii lahaanshaha dhulka, dhulkaasina wuxuu  noqonayaa mulki dawladeed.

QODOBKA 13AAD: MUDDADA OGOLAANSHAHA DHISMAHA

Qof  kasta oo haysta Dukumentiga lahaanshe dhul rasmi ah waa inuu qaato ruqsad ogolaansho dhisme oo uu ogolaanayo maamulka dawladda hoose iyo Wasaaradda Hawlaha guud, isagoo bixinaya dhammaan Cashuuraha ku waajibey.

 QODOBKA 14AAD: BIXINTA JAGO DHISME

1)  Maamulka Dawladda Hoose, iyadoo dhawraysa sharcigan iyo shuruucda kale ee u yaalla  qorshaha magaalooyinka dalka Somaliland (Town Planing & Town ship Rules) waxay awood u leedahay inay siiso dhul qof kasta oo muwaadin ah, Shirkad, Uurur Waddani iyo Hay’addaha Dawladda.

2)  Maamulka Dawladda Hoose waxay awood u leedahay in ay si ku meel gaadh ah uga Kiryaso dhul Shirkadaha Shisheeyaha ah iyo kuwa Waddaniga ahba.

3)  Siimada ku cad  farqadda 1aad ee qodobkan waxay ku xidhan tahay in la bixiyo qiimo go’an (Premium of Land) oo lagu jaangooyay Mitir Laba Jibaaran.

4)  Qiimaha Cashuurta Jago Rasmi ah ama mid ku meel gaadh ahi waxay noqonayaan, tan ku xusan, Tacriifadda cashuuraha midaysan ee Dawladaha Hoose.

 QODOBKA 15AAD: HABKA QAYBINTA JAGOOYINKA (PLOTS)

1)  Jagooyinka dhismaha waxa lagu qaybinayaa hab ku saleysan sinnaan iyo cadaalad, iyadoo laga duulayo xaqa sinnaanta muwaadiniinta,

2)  Maamulka Dawladda Hoose marka ay bixineyso Jago degsiimo isticmaal rasmi ah waxay  tixgelineysa Arrimahan soo socda:-

    a) In da’ada qofka jagada soo weydiistay aanu ka yareyn 18 sano.

    b) In aanu lahayn jago kale oo bannaan.

    c) In uu leeyahay awood dhaqaale oo uu ku maamulo kuna dhisi karo.

3)  Maamulka Dawladda Hoose iyagoo tixgelinaya duruufo gaar ah oo la soo hubiyey, wuxuu awood u leeyahay in ay dhul siiyaan qof ka yar 18 sano.

QODOBKA 16AAD: DHULKA DHISME EE MUSHAARIIC GAAR AHAANEED

1)  Cidda dooneysa dhul dhisme oo ay ku fuliso Mashruuc gaar ahaaneed, oo ka mid ah mashaariicda horumarinta dalka, sida Wershadaha, meelaha Waxbarashada, Huteelada waaweyn ee Dalxiiska iwm waxay ogolaansho ka soo qaadanayaan tusmada Mashruuceed Hay’adaha Dawladda ee ku shaqo leh Mashruucaas, iyagoo soo bandhiggaya Naqshada dhismaha Mashruucaas.

2)  Dhulka lagu bixiyey habkaa ee ku tilmaaman xubinta 1aad ee qodobkan laguma isticmaali karo dhisme ama degsiimo kale oo aan la lahayn Mashruuca xidhiidh.

3)  Mashruucaas waa in dhismihiisa la bilaabo muddo aan ka badneyn hal sano gudahood.

 QODOBKA 17AAD: WAAJIBAADKA QOFKA JAGO LA SIIYO

1.  Qofka la siiyo jago waa inuu shuruudahan buuxiyaa:-

    a)     in uu dhawro sharcigan iyo dhammaan Shuruucda kale ee  dalka JSL.

    b)     in uu fasax ka haysto maamulka dawladda hoose.

    c)      In uu dhismaha waafajiyo naqshadda guud ee xaafadda uu dhismaha ka dhisaayo.

    d)     In uu u isticmaalo jagada  ujeedada loo siiyey oo keli ah, haddii aanu Guddida naqshadaha Qaranka ka helin ogolaansho fasax oo jeeddadii hore ka bedelaya.

    e)     In uu dhismaha  bilaabo wakhtiga loo qabtey oo ku cad warqadda jago bixinta.

2.  Qofka u hoggaansami waaya nidaamka ku xusan xubinta 1aad ee qodabkan,  ee lagu soo caddeeyo   wuxuu maamulka Dawladaha Hoose soo saarayaa amar la noqosho jago hore loo siiyey ,iyadoo aan la siineyn wax magdhaw ah.

 QODDOBKA 18AAD: JOOJINTA DHISMAHA

1)   Markey  jirto sababo garawshiiyo leh lagalana tashado Wasaaradda Hawlaha Guud, Dawladda Hoose waxay amri kartaa joojinta dhisme oo aan ka badneyn muddo sodon (30) cisho ah (muddo joojinta dhismuhu kuma xisaabsana muddada loo qabtey dhismaha inuu qofku ku dhiso jagadaas)

2)   Waxa kale oo ay amri kartaa joojinta dhisme la bilaabey ama socda iyadoo sababtu tahay dib-habeynta degsiimadaas ama ku xadgudubka waajibaadka Qoddobka 17aad ee Sharcigan.

3)   Qofka dhismahaas laga joojiyey ma sheegan karo wax xuquuq ah oo la xiddhiidha muddadaas joojinta.

4)   Xubinta kowaad ee qoddobka muddada ku cad kuma jiro dhulka lahaanshihiisa muran ka taagan yahay (Dacwadi ka jirta), ilaa uu dhaco xukun ay  Maxkamadi go’aan kaga gaadhay .

 QODDOBKA 19AAD: MUDDADA LAHAANSHAHA DHISMAHA RASMIGA AH

Muddada dhismaha rasmiga ah waxay noqoneysaa sidan soo socota:-

a)     Qof kasta oo la siiyey dhul rasmi ah buuxiyeyna shuruudaha sharcigan, isla markaana ka dhistey Hanti ma guurto ah, muddada lahaanshaha dhulku waxay noqoneysaa ABADI.

b)    Sida uu dhigayo Distoorka JSL, qodobka 8aad, farqadda 3aad, dadka Ajinebiga ahi waxay muddada siismada kala mid yihiin muwaadiniinta JSL, sidoo kalena waxay kala mid yihiin habka kala wareegidda.

c)     Warqadaha lahaanshaha dhismaha (Mulkiyada), waa in ay ku muujisan tahay muddada ku dhaqanka dhulku.

d)    Mulkiyadda waxa la siin karaa qof, marka uu dhismuhu gaadho Litenka (Fowqal fiyaaraha).

 QODOBKA 20AAD: DHISME SHARCI DARRO AH

Dhisme kasta oo aan la soo marin habka jago bixintan leh isticmaal rasmi ah iyo kan leh isticmaal ku meel gaadh ah waxaa loo aqoonsanayaa mid sharci darro ah.

 QODOBKA 21AAD: RARSITA IYO DUMISTA DHISME SHARCI DARRO AH

1)  Maamulka Dawladdaha Hoose iyagoo fulinaaya Naqshadda Guud ee Magaalada, waxay awood u leedahay duminta dhismooyinka sharci darada lagu dhisto, ha ahaado mid si rasmi ah ama ku meel gaadh ah.

2)  Rarida dhisme ku meel gaadh ahi waxay ku iman kartaa:-

    a) Rarida Xaafad dhan, waxaaney dhacaysaa marka loo baahdo ama dhulka Xaafaddu haysataa yahay mid soo gelaya ku talo galka Naqshadda guud, loona qorsheeyey arrimo ka duwan, degsiimaha caadiga ah.

    b) Waana in la dejiyaa dadkaas meel ku haboon, kharashka raridda iyo dejinta waxaa bixineysa Dawladda Hoose.

3)  Dhismaha sharci darrada ah ma noqon karo sabab lagu helo jago, raristiisuna mag dhaw ma dhalin karto.

4)  Jago bixinta ka dhalata dumin ama rarid dhismooyin kooban ama Xaafad dhan meesha la dejinaayo waxa xaq u leh dadka la soo rarey oo qudha.

 QODOBKA 22AAD: DUMINTA DHISME SHARCI AH

Marka dhisme sharci ah la dumiyo soona galo dib u habeynta Naqshadda Guud ee Magaalada ama Xaafadda (Re-planing of town Master Plan), qofka lihi wuxuu xaq u yeelanayaa:-

a)     In la siiyo Magdhaw u dhigma dhismaha laga dumiyey lagana tirtiro sharcigiisii hore.

b)     In la siiyo Jago aan cabir ahaan ka yareyn tiisii hore ee laga dumiyey looguna sameeyo sharci cusub.

QODOBKA 23AAD: LA WAREEGID JAGO DAN-GUUD AWGEED  (Qodobkan waxbaa la bedellay)

1)  Duqa Magaaladu marka uu la tashado Guddiga fulinta kana helo ogolaansho Guddiga Qaranka ee Naqshadaha Guud  wuxuu awood u leeyahay inuu soo saaro go’aan la wareegid jago dhisan ama jago banaan oo hore cid loo siiyay Dan Guud awgeed.

2)  Qofka lagu fuliyo go’aanka kor ku xusan ee xubinta 1aad wuxuu xaq u leeyahay waxayaalaha soo socda:-

a)  Qofka lahaa Jagadu waxa uu xaq u yeelanayaa Mag-dhaw u dhigma wixii jagadaas ugu dhisnaa.

b)  In la siiyo Jago u dhiganta (Goob ahaan iyo Cabir ahaanba) Jagadii lagala wareegay.

3)  Marka la bixinaayo Mag-dhaw waxaa la tixgalinayaa Dhismuhu in uu yahay mid waafaqsan Shuruucda.

4)  Dhismaha khilaafsan Shuruucda xubinta 3aad ee qodobkan waxa loo aqoonsanayaa mid sharci darro ah, qofkuna xaq u yeelan maayo wax Mag-dhaw ah waxaana lagu xumkumayaa kharashka lagu rarayo.

5)  Habka iyo qaabka loo marayo la wareegidda Hanti gaar ahaaneed Dan-guud awgeed waa in ay waafaqsanaata sharciga dhulka iyo Distoorka JSL.

6)  Hantida loola wareegay Dan-guud awgeed iyadoo la dhawraayo xubinta 5aad ee qodobkan, waxaa loo isticmaalayaa Dan-guud oo keli ah, waxaana reeban in loo isticmaalo dan gaar ahaaneed.

QODOBKA 24AAD:

Qofna kuma dacwoon karo lahaansho  dhul hore looga qaaday dan guud awgeed.

 QODOBKA 25AAD: IIBKA JAGO BANNAAN

1)  Qof la siiyay jago isticmaal rasmi ah ee si joogto ah u bixinayay cashuur-sanadeedka ku waajibay wuu iibin karaa, hibayn karaa, wareejin karaa, ugu takri fali karaa sifo kasta oo sharcigu oggol yahay.

2)  Xuquuqda farqada kowaad ku xusan malaha dadka caadaysta ka ganacsiga dhulka banaan ee ay soo xaqiijiyeen hay’addaha sharciga iyo dawlada hoose .

3)  Haddii qof la siiyay jago ku taal meel muhiim ah(sida wajahadaha jidadka waaweyn ) ee aan awoodi karin inuu dhiso. Marka Gudiga Qaranka ee naqshadaha iyo mamulka D/hoose isla gartaan in jagadaa baanananteedu aanay ku haboonan bilicda magaaladda  waxay D/hoose kala noqon kartaa  warqada jago bixinta, iyagoo ugu badalaya jago ku jirta naqshada magaalada oo munaasib ah.

QODOBKA 26AAD: NAADADA JAGO LEH ISTICMAAL RASMI AH

1)  Marka la bixinaayo jago leh isticmaal rasmi ah waxa la sameynayaa Naado lagu soo saarayo Wargeysyada, Warbaahinta, Idaacadda, laguna dhejinayo boodhka Dawladda Hoose (Notice Board )

2)  Cidda dood ama hor istaagid ka qabta bixnta jagadaasi waxay la xidhiidhaysaa Dawladda Hoose ee Magaaladaas, muddo ku siman (60) Maalimood gudahood, laga bilaabo maalinta la naadiyey.

QODOBKA 27AAD: DIIWAN GELINTA JAGOOYINKA

1)  Dawladaha Hoose ee Magaalooyinku waxay sameynayaan diiwaano lagu qoro noocyada kala duwan ee Jagooyinka iyo dhammaan Sharciyada la xidhiidha Dhismaha Jagooyinka.

2)  Diiwan gelinta Jagooyinka waa in ay ahaataa mid ku saleysan haysasho Dukumantiyad lahaanshaha oo waafaqsan jago ama warqadaha caddeynaya lahaanshaha jagadaas ama Xukun Maxkamadeed oo caddaynaya lahaanshaha jagadaas, waana in lagu xusaa Diiwaanka Dawladda Hoose iyo kan Xafiiska Hawlaha Guud .

3)  Xafiiska naqshadaha ee Wasaarada Hawlaha Guud waxay kaydinayaan nuqulo waraaqaha jagooyinka leh isticmaalka rasmiga ah ee la bixiyo .

 QODOBKA 28AAD: GARSOORKA DACWADAHA DHULKA  (Qodobkan waxbaa la bedellay)

1)  Dhammaan Dacwadaha ku saabsan Dhulka waxa ka Garnaqaya Guddiga Garnaqista Dhulka laysku haysto oo ka kooban:-

    a) Hal Qof oo Garsoore Maxkamadda Degmada ah                Guddoomiye

    b) Hal Qof oo Wasaaradda Hawlaha Guud Degmada              Xoghayn

    c) Hal Qof oo Dawladda Hoose Degmada                                  Xubin

    d) Hal Qof oo Wasaaradda Diinta & Awqaafta Degmada        Xubin 

    e) Hal Qof oo Golaha Degaanka Degmada                                 Xubin.

 2)  Guddiga Farqadda 1aad ku sheegan wax qof kasta oo ka mid ah soo magacaabaya Hay’adda ama Wasaaradda uu ka tirsan yahay, mudada xilkoodu waa 2 Sanadood, waase loo cusboonaysiin karaa haddii loo garto.

3)  Guddigu wuxuu yeelanaya Gunno Fadhi oo dhan 20,000/-Sl.Sh maalin kasta oo ay shaqeeyan, waxaana bixinaya gunnadaas Dawladda Hoose ee Degmada.

4)  Dhinaca soo dacwooda waxa Dawladda Hoose ka qaadaysa inta aan dacwadda la bilaabin lacag Barabare ah (Fee) oo dhan 200,000/- Sl.Sh oo aan celis lahayn.

5) Kharashka dacwadaas ka dhasha waxa la saaraya dhinaca Xukunku ku dhaco haddii aan Rafcaan  uga qaadan Maxkamadda Gobolka.

6)  Guddidu waxay fadhigeedu noqonayaa Xarunta Dawladda Hoose, waxaana fadhiyadooda iskugu yeedhi kara Guddoomiyaha,  Dukumantiyada Dacwadaha waxaa haynaya Xoghayntooda.

7)  Go’aanada Guddigu soo saarto waxa fulintooda u xilsaaran Dawladda Hoose, haddii aan Rafcaan laga qaadan.

8)  Guddigu waxay samaysanaysaa Xeer-hoosaad ay ku maamulan gudashada xilkooda kaas oo aan ka hor imanayn Sharcigan.

 QODOBKA 29AAD: CIQAABTA  (Qodobkan waxbaa la bedellay)

1)  Qof kasta oo ku xadgudba sharcigan waxa lagu ganaxayaa 1 hal milyaan ilaa 2 laba milyaan  shilin (1,000,000, -  2,000,000), waxaanu mutaysanayaa  xadhig adag oo hal sano ilaa saddex sano ,oo aan iib lahayn ,isagoo bixinayaa wixii kharash ah ee dacwadaas dhinaca kale kaga baxay , iyadoo aan wax loo dhimayn xeerka ciqaabta guud.

2) Masuulinta loo xil saaray dhul bixiinta ee ku xad-gudba qodobada sharcigan waxa lagu ciqaabayaa  laba sano ilaa shan sano oo xadhig aan iib lahayn.

3) Kharashka ka dhasha  dacwadahaas waxa ka masuul ah xad gudbaha .

 QODOBKA 30AAD: GUDOONKA DHUL BIXINTA

1)  Gudoonka bixinta dhulka leh istcimaal Rasmi ah  waxa lagu soo saarayaa amarka  Gudoomiyaha gudiga fulinta Dawladda Hoose,  ka dib marka uu sidaas gudoonsado  Gudiga fulintu .

2)  Hab-raaca dhul bixinta waxa lagu soo saaraya xeer nidaamiye ay ogolaadeen Gudiga  fulinta ee dawlada hoose .

QODOBKA 31 AAD: IIBKA DHULKA IYO DHISMAYAASHA DAWLADA

1)  Wixii Dhul Dawladeed ah ee dan loo arko in laga Iibiyo Qof, Shirkad, Safaarad, IWM ee leh sifo la oggolaaday, waxa Iibin kara oo keliya Dawladda Dhexe, oo ay ka Wakiil yihiin Guddi Qaran oo ka kooban:-

    a) Wasiirka Wasaaradda Hawlaha Guud               Guddoomiye

    b) Wasiirka Wasaaradda Maaliyaddda                  Xubin

    c) Xeer-Ilaaliyaha Guud ee Qaranka                     Xubin

    e) Hanti Dhawraha Guud ee Qaranka                  Xoghayn.

2)  Haddii dan loo arko in la Iibiyo Dhisme ay Dawladu leedahay waxaa loo raacayaa sidan:-

a)  Dhismaha Dawladda Hoose ee Degmo leedahay waxa Iibikiisa ogolaanaya Golaha Degaanka ee Degmada, ka dibna waa la naadinayaa si loogu tartamo.

b)  Dhismaha Dawladda Dhexe leedahay waxa Iibkiisa soo jeedinaya Guddiga Qaranka ee ku sheegan Faqradda 1aad ee Qodobkan, waxaana ogolaanaya Madaxweynaha JSL.

 QODOBKA 32 AAD: GUDIGA TAYO/FAYO DHAWRKA

1)  Gudigani wuxuu ka koobnaanaya aqoonyahano farsamo iyo Saraakiil caafimaad (fayo dhawrayaal sare ) oo ka socda D/hoose, Wasaaradaha Cafimaadka iyo Hawlaha Guud.

2)  Gudigu wuxuu ogolaanayaa nashqadaha dhismeyaasha, isagoo hubinaaya inay waafaqsan yihiin heerka tayo-dhisme  ( national building codes) iyo fayo-dhawr ee loo dejiyey.

3)  Dhismaha gudiga iyo qaabka Shaqadooda  waxa lagu soo saaraya  xeer midaamiye.
