Somaliland Press & Publications Bill 2007

 This is the Somali text 0f the highly controversial Somaliland Press and Publications Bill which has been submitted, in early November 2007 ,  by the Government to the House of Representatives for approval.  In many countries, bills, like these, are normally consulted upon very widely before they are introduced at the Parliament. The Somaliland Government has done that, in the past, with the current Press Law 2004, which was first published, as a bill, in 1999.

 The 2004 Press Law set up a system largely based on self regulation and reliance on the civil law, rather than the criminal law.  Nonetheless many journalists, including prominent editors and publishers, have been detained and prosecuted under the old 1962 Somali Penal Code. Unfortunately, the Supreme Court has also held that the 2004 Press Law was a subordinate law which did not overrule some of the draconian provisions of the 1962 Penal, which, in our view, did not survive the Somaliland Constitution, let alone the repealing articles of the Press Law 2004.

 The Somaliland Government has repeatedly stated that it shall issue a new “Media Law” and has now decided to push for a wholesale repeal of the current current Press Law, which consists of 32 articles and a code and prposes to replace it with this Bill which consist of  120 articles. The Bill proposes a strict registration regime for all producers of the press, other publications, news agencies, printing presses, publishing houses, bookshops, and even newspaper distributors. Ministers are given considerable powers over the regulation of the press and publishers and more than 15 new offences have been created which are punishable by fines and imprisonment for a period of up to 2 years. The Bill specifically confirms that the array of other criminal sanctions in, for example, the Penal Code, shall remain.

 Exceptionally, the Bill states that its English version shall be the official one, for interpretation purposes, but it is not clear whether that version has also been submitted to the House.

Although the Government has announced that this Bill was drafted by experts relying on international press laws, this Bill is almost word for word a reproduction of the Yemen Law No: 25 of 1990 on the Press & Publications,  which even Yemen is planning to repeal.

The provisions of this bill (and the Yemeni Law it is based on) run contrary to international norms relating to freedom of expression and the independence of the press and are not in line with the Somaliland constitution.  The considerable powers given to ministers, the compulsory registration of all press and publication activities, including the profession of journalism and the extensive criminal sanctions which add to the existing array of criminal offences in the Penal Code contrast sharply with the current Somaliland Press  Law (2004),  which contains no criminal sanctions and is based on codes of conduct.

Somalilandlaw.com urges the House of Representatives to reject this bill completely.

Improvements of the current Press Law can be made, in consultation with the media and the civil society. The self regulation of the press can be strengthened; a modern civil law dealing with issues of libel adopted; all criminal sanctions in the Penal Code affecting the press repealed; registration of press activities beyond that which is necessary for all businesses  abolished; separate broadcasting laws adopted and measures to entrench freedom of information and expression  introduced.

Iyada oo la xeerinayo shuruudaha Qodobka 11aad ee sharcigan, codsiyada lagu codsanayo Kaadhka Saxaafadda waxa loo qoranayaa Wasaaradda Warfaafinta iyada oo ay la socdaan dukumentiga kale ee loo baahan yahay. Haddii diidmo la sababeeyey kaga soo noqoto ama warceliniba ka soo noqon weydo muddo dhan 30 maalmood , waxa uu codsaduhu u racfaan qaadanayaa cidda ku habboon muddo ku siman 30 beri gudahood markii uu diidmada helay ama ay ka soo wareegtey codsigiisa  warcelin la’aantu ku dhacday.

Xuquuqda & Waajibaadka Suxufiyiinta

Waxa uu xaq u leeyahay in uu uga hadlo sida uu u arko tooska ee waafaqsan Dastuurka si uu u cabbiro aragtidiisa si kastaba ha loogu kala tagganaado fikirka iyo aragtida e.

a)            Suxufigu weriye waa uu u noqon karaa dhawr hay’ad saxaafadeed oo maxalli ah ama ajinebi ah isla mar keliya haddii uu ruqsad labadii sannadoodba mar la cusboonaysiinayo ka haysto Wasaaradda Warfaafinta.

b)            Suxufigu xaq ayuu u leeyahay in uu ka warramo/ka warbixiyo dhacdo kasta oo maxalli ah ama caalami ah iyada oo aanu dabrayn xidhiidhka dalkaasi laga warbixinayaa la leeyahay Jamhuuriyadda Somaliland.

Suxufigu lagama eryi karo, lagamana beddeli karo mihnaddiisa, shaqadiisa lagama joojin karo, lagama hor istaagi karo in uu wax qoro, oo looma qabsan karo maqaalladiisa sida uu sharcigani oggol yahay mooyaane.

Suxufigu waxa uu ku badbaadin karaa xuquudiisa isaga oo adeegsanaya ururkiisa saxaafadeed iyo jid kasta oo sharci oo uu u bannaynayo Datuurku, dammaanadna uu u siiyey sharcigu, waxana uu si toos ah ula kaashan karaa hay’adaha caddaaladda ee waafaqsan shuruucda.

Suxufiyiintu Waxa ay xaq u leeyihiin inay samaystaan Ururro/xidhiidho. Ururadaasi kuwo madax bannaan ayay ahaanayaan. Iyada oo la adeegsanayo cod, waxa ururradu samaysan karaan xeer-nidaamiyeyaal aan ka hor imanayn sharcigan. Guddoomiyaha ururka, oo ka mid noqonayaa Golaha Agaasinka (Board of Directors) waxa lagu soo dooranayaa si dimuqraadi ah.

Ururada suxufiyiintu waxa ay samaysanayaan xeerar anshax oo ururku dhexdiisa ka hirgeliyo, oo ay ka jiraan mabaadii’da aasaasiga ah ee waajibka ku ah suxufiyiinta:
